Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions.

The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

Application means the software program provided by the Company downloaded by You on any electronic device, named Foodinjoy

Account means a unique account created for You to access our Service or parts of our Service.

Promoter (referred to as either "the Promoter", "We", "Us" or "Our" in this Agreement) refers to FOODINJOY LTD, 85 GREAT PORTLAND STREET, FIRST FLOOR, LONDON, W1W 7LT.

Country refers to: United Kingdom

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

In-app Purchase refers to the purchase of a product, item, service or Subscription made through the Application and subject to these Terms and Conditions and/or the Application Store's own terms and conditions.

Promotions refer to contests, sweepstakes, or other promotions offered monthly or annually through the “Win Rewards” Service.

Promotions Terms and Conditions (also referred as "Promotion Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the “Win Rewards” Promotional Service.

Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

Website refers to Foodinjoy, accessible from http://foodinjoy.co.uk

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

• By taking part in this promotion all participants (“You”) will be deemed to have accepted and be bound by these terms and conditions.
• The Promotional draw is open to UK residents (England, Scotland, Wales and Northern Ireland) aged 18 or over.
• Employees or agencies of the Promoter, its group companies or their family members, or anyone else professionally connected with the Promotions may not enter the “Win Rewards” Draw.
• To enter the Promotions, You must complete the threshold condition set out in the Application. No purchase is necessary.
• To increase chance of winning, You can buy an Entry only through In-app Purchase. A maximum of five entries per Account is permitted.
• There is no general right for any user to buy an Entry. The Promoter can refuse to sell Entries to anyone, and/or limit the number of Entries You can buy, without giving a reason.
• For “Lucky Draw”, the opening date and time for receipt of entries is 00:01 on the first day of each month and the closing date and time for receipt of entries is 23:59 on the 28th day of each month until the Promoter chooses to end the promotion. For “Bumper Draw”, the opening date and time for receipt of entries is 00:01 on the first day of each year and the closing date and time for receipt of entries is 23:59 on the 24 December every year. Entries received outside this time period will not be considered.
• Prize amount as promoted within the Application will be awarded to the winner of each draw. The prize is non-transferable, non-refundable and cannot be exchanged for any cash alternatives in whole or in part. The decisions of the Promoter are final in relation to the Promotion.
• Winner will be chosen from a random draw of entries received in accordance with these Promotion Terms. The draw will be performed by a random computer process. The winners will be notified by email no later than the (a) 10th day of next month for Lucky Draw and (b) 10th January next year for Bumper Draw. Prize must be claimed within 10 days of the initial notification. All reasonable effort will be made to contact the winners; however, if the prizes are not claimed within 10 days a re-draw will take place.
• The prize winner may be required to participate in and give their consent to related publicity including their names and photographs being used for promotional purposes and/or reasonable requests to take part in the Promoters’ publicity without additional compensation or prior notice.
• Prizes are awarded at the promoter's discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant.
• The Promoter reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Promotions with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of the Promoter in all matters under its control is final and binding and no correspondence will be entered into.
• The Prize will be sent to the winner by the Promoter through email or post.
• By entering the promotion, all entrants acknowledge that their personal data will be used by the Promoter for the purposes of the administration of this promotion only, including contacting winning entrants. Unless otherwise indicated, the responses to the questions that you provide after winning will be used by the Promoter, following their privacy policy, in an aggregated manner only and will not be linked to your personal information.
• The Promoter may be required to provide evidence that a valid prize award has taken place. As a result, it may provide a winner’s name and the county in which they live in response to a request from a third party. If you do not wish for your data to be made public for this purpose should you win a prize please inform us by emailing help@foodinjoy.co.uk.
• The promoter accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by You as a result of entering the Promotions or accepting the prize. The Promoter further disclaims liability for any injury or damage to your or any other person's Device relating to or resulting from participation in or downloading any materials in connection with the Promotions.
• The Promoter shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
• The Promotions will be governed by English law and entrants to the Promotions submit to the exclusive jurisdiction of the English courts.
